AGREEMENT BETWEEN CUSTOMER AND AIRPORT SUPER EXPRESS, INC.

This website is offered to customers of Airport Super Express, Inc. Please read the terms and conditions carefully. By accessing this website, you agree to abide by the terms and conditions below. These terms and conditions are subject to change from time to time without notice at our sole discretion. We will notify our customers of amendments to these terms and conditions by posting an alert on our website’s homepage. If you do not AGREE with these terms and conditions, please do not access this website.

PERSONAL AND NONCOMMERCIAL USE LIMITATION

This website is for your personal and noncommercial use. The content and information on this website (including, without limitation, price and availability of shuttle services), as well as the infrastructure used to provide such content and information, is property of Airport Super Express, Inc. Accordingly, as a condition of using this website, you agree not to use this website, its contents (graphics, images, & wording) or information for any commercial or non-personal purpose (direct or indirect). While you may make limited copies of your tour itinerary (and related documents) for travel or services purchased through this website, you agree not to modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or services obtained from this website. In addition, whether or not you have a commercial purpose, you agree not to:


(I) Access, monitor or copy any content or information of this Website using any robot, spider, scraper or other automated means or any manual process for any purpose without express written permission of Airport Super Express, Inc.
(II) Violate the restrictions in any robot exclusion headers on this Website or bypass or circumvent other measures employed to prevent or limit access to this Website;
(III)Take any action that imposes, or may impose, in the discretion of Airport Super Express, Inc. an unreasonable or disproportionately large load on the Airport Super Express, Inc. infrastructure.

EXCLUSION OF WARRANTY

This website is only a venue. Airport Super Express, Inc. has no control over third-party websites and the content of data about our services provided on those sites. Airport Super Express, Inc. and any of our third party providers and affiliates do not warrant the accuracy, completeness, currency or reliability of any of the content or data found on this site and such parties expressly disclaim all warranties and conditions, including implied warranties and conditions of merchantability, fitness for a particular purpose and non-infringement, and those arising by statute or otherwise in law or from a course of dealing or usage of trade.

Neither Airport Super Express, Inc. nor any third party providers warrant that this website, our servers or any e-mail sent from Airport Super Express, Inc. are free of viruses or other harmful components. Some states do not allow this disclaimer of implied warranties so the foregoing disclaimer may not apply to you. This warranty gives you specific rights, which vary from state to state.

The Information, Software, and Services published on this website may include inaccuracies or typographical errors. In particular, Airport Super Express, Inc. and its affiliates do not guarantee to the information and description of the tours and other travel products displayed on this website. All such information, software, and services are provided “as is” without warranty of any kind. Airport Super Express, Inc., its affiliates, and/or their respective suppliers hereby disclaim all warranties and conditions with regard to this information, software, and services, including all implied warranties and conditions of merchantability, fitness for a particular purpose, title and no infringement.

Airport Super Express, Inc. and its affiliates are not liable for the acts, errors, omissions, representations, warranties, breaches or negligence of any such suppliers or for any personal injuries, death, property damage, or other damages or expenses resulting therefrom. Airport Super Express, Inc. and its affiliates have no liability and will make no refund in the event of any delay, cancellation, overbooking, strike, force majeure or other cuases beyond their direct control, and they have no responsibility for any additional expense, omissions, delays, re-routing or acts of any government or authority.

In no event shall Airport Super Express, Inc. , its affiliates, and/or their respective suppliers be liable for any direct, indirect, punitive, incidental, special or consequential damages arising out of, or in any way connected with, the use of this website or with the delay or inability to use this website, or for any informations, software, products, and services obtained through this website, or otherwise arising out of the use of this website, whether based on contract, tort, strict liability, or ohterwise, even if Airport Super Express, Inc., its affiliates, and/or their respective suppliers have been advised of the possibility of damages. Beacause some states/jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you.

AVAILABILITY & RESERVATIONS

Request for reservation is how Airport Super Express, Inc and the customer come to contact for an agreement for service. During a request for reservation, a customer gives contact information such as name, phone, and e-mail. We use this information to process a NON-CONFIRMED reservation and is not disclosed to any third parties or affiliates. Airport Super Express, Inc. is at no time or form committed to the date and service selected until one of our representatives via phone, e-mail or fax has confirmed a reservation.

All reservations (including online) MUST be made at least 24 hours in advance by phone, e-mail: info@airportsuperexpress.com & reservations@airportsuperexpress.com or completely filling the reservation form found on our reservations page at http://www.airportsuperexpress.com/reservations_e.html. All reservations are subject to availability; any changes to a reservation must be made by phone (305)807-0270 or email: reservations@airportsuperexpress.com

The online form being submitted is only a request for availability and does not commit Airport Super Express, Inc. and your party to specific dates, hours, and rates. You will receive a response by phone or e-mail to confirm such said dates, hours, and rates according to your submission.

Although, a confirmation request does not commit Airport Super Express and a customer to its Terms & Conditions described in our privacy policy, it does, however, become official once a customer confirms their request for service.

PRICING & PAYMENT

All prices are published at our web page and/or brochures; the prices are listed in US Dollars per trip. Special rates and conditions may apply in Black-Out Dates: New Years, Memorial Day, Independence Day, Labor Day, Thanksgiving, Christmas days and any other Holiday listed in the USA calendar. Any activity with Airport Super Express, Inc. is subject to prepaid conditions, type of payments like Credit Card, Cash and Travelers Checks are accepted as a payment. You shall be completely responsible for all charges, fees, duties, taxes, and assessments arising out of your use of this website, and, without limitation, you shall be responsible for all charges, fees, duties, taxes, and assessments arising out of transactions performed by Airport Super Express, Inc. on your behalf, whether or not such uses were performed with your consent.

CANCELLATIONS, NO SHOW, & GRACE PERIOD

In order to avoid any cancellation fee or 100% penalty, cancellations MUST be made 24hrs in advance. Every customer is responsible for his/her own cancellation by calling our customer service line at 305-807-0270 or via email at reservations@airportsuperexpress.com before the 24-hour deadline. Once a customer cancels a reservation prior to the 24-hour deadline, they receive a cancellation confirmation via e-mail as documentation. Partial cancellations DO NOT count as a complete cancellation; i.e. after scheduling a reservation and calling to potentially cancel based on other accommodations, but never calling and/or e-mailing with a follow up to cancel. If a party cancels a reservation after the 24-hour period, your credit card WILL BE CHARGED for the full amount (as specified in your confirmation e-mail); this only applies to the reservation not meeting the cancellation policy (in cases of round trips).

The No-Show or same date cancellation are also subject to 100% penalty charge, which ARE NOT entitled to a refund. If any information on the reservation is missing such as date of the tour, hotel, port, or other location pick up, the customer is responsible to provide such missing information before the scheduled date, otherwise the cancellation policy may apply to the reservation. The date on which the cancellation notice is received to Airport Super Express, Inc. its agents will determine the applicable cancellation fee, if any. It would be advisable to follow up with a phone call. We do not take any responsibility for cancellation fees resulting from customer mistakes -such as failing to follow instructions (sent via your e-mail confirmation), forgetting to cancel or not fully cancelling a scheduled reservation, the weather, family emergencies, double booking or providing wrong dates and/or information.

Furthermore, in order to keep our customers satisfied by being punctual, a MAXIMUM 10-minute grace period will be allowed for pick-ups at hotels, residence, or other locations –such as malls, shopping districts, conventions, office, etc.; this does not apply to airport or cruise port pick-ups. After the grace period, the driver will leave in order to make his/her next scheduled pick-up and your credit card will be charged for the full amount, which will also include an additional $5 fee for exceeding the waiting time.

FEE FOR CHANGING DATES AND/OR TIME:

$20 per reservation. This fee applies only to existing orders that a Customer wishes to make date and/or time changes to last minute. Last minute changes can affect other reservations, thus, make sure that you are certain with your desired pick-up and/or departure time. This does not apply to Airport Super Express, Inc. tickets or other tours/activities where the web page indicates that no changes are allowed.

NOTICES

Airport Super Express, Inc. shall not be liable for circumstances beyond its control including weather (Hurricane, Tropical Storm etc), road conditions and breakdowns. Airport Super Express, Inc. reserves the right to substitute vehicle in the event the shuttle for reasons beyond its control, is unable to perform under this agreement. Airport Super Express, Inc. assumes no responsibility for lost or damaged baggage or personal BELONGINGS or for any items left in the shuttle. While every effort is made to ensure specified times are met, if the shuttle is late in excess due to unforeseen traffic, uncontrollable weather conditions (Hurricane, Tropical Storm etc), or other circumstances beyond our control, the customer will be informed about the situation by our dispatcher –and in some instances, driver.

By agreeing to the Terms & Conditions described in our privacy policy, you authorize Airport Super Express, Inc. to make charges to the credit card on file to prepay your reservation(s) and cancellations not meeting our cancellation requirement.

As of October 1, 2009, all Port of Miami pick-ups MUST BE prepaid prior to your arrival/departure. This is done for your protection due to recent scammers deceiving our customers pretending to be Airport Super Express representatives by holding a happy face sign and/or by coincidence your name on a clipboard. We DO NOT have any representatives standing at any Terminals at the Port of Miami waiting for your departure. We are in no way shape or form responsible for deceit caused by these scammers and as a result end up paying for additional transportation. In which case, we ARE NOT obligated or entitled to issue refunds as our instructions clearly state the procedures to follow.

ACCESS

Our shuttles are not wheelchair accessible. If you intend to travel in our shuttle, which has not been designed or adapted for wheelchair access, you must satisfy yourself as to its suitability before embarking and withdraw Airport Super Express, Inc. from any and all liability. When traveling on any of our shuttles not adapted or designed for handicap access, if you use a wheelchair or need assistance to climb onto the shuttle, you must bring enough helpers to enable you to make your journey safely including getting on board the shuttle and arriving at your destination. Because our shuttles are not designed or adapted for wheelchair access it may not be possible for you to sit in a wheelchair, for reasons of safety, you may be asked to move from your wheelchair into a regular seat, in which case the wheelchair will be stowed in a safe place. Airport Super Express, Inc. shall not be liable for any circumstances beyond its control including injuries, accidents, damage, or hurt of any handicap passenger. PLEASE READ THIS INFORMATION CAREFULLY. BY ACCESSING THIS INFORMATION YOU AGREE TO BE WELL-INFORMED BY OUR ACCESS CONDITIONS. THIS INFORMATION IS SUBJECT TO CHANGE WITHOUT NOTICE, FROM TIME TO TIME AT OUR SOLE DISCRETION.

LUGAGGE, BELONGINGS

For safety reasons, and for the comfort of passengers, we have to restrict the amount and type of luggage, including pushchairs and shopping trolleys. You may, at the discretion of the leader, take with you the following items, provided they do not obstruct access to safety and life saving equipment: personal small bags (purse, brief case, laptop, etc), Strollers, carry-on (duffle bag) & standard luggage (60lbs or lighter).

ANIMALS ON BOARD:

Pets are not permitted in the vehicle, except guide dogs for people who are visually or hearing impaired, or service animals specially trained to assist riders with disabilities. Airport Super Express, Inc. recommends the passenger to inform, at the time of reservation, if any of the mentioned service animals are to be accompanying them, in order to prepare our shuttle in a way that provides a better service and comfort.

LOST PROPERTY

We deal with lost property in accordance with our lost property procedures, which are available for inspection on request. If you find any lost property on our busses, do not touch it. However, we do ask that you please alert the shuttle driver immediately. If we think unattended property may be a security threat, the police or security services may be called to attend and the item(s) may be destroyed.
